1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Get Fixed Bets website, mobile application, and related services (collectively, the "Service") operated by Get Fixed Bets ("we", "us", "our"). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of the Service
Get Fixed Bets is a subscription-based AI race analysis tool. The Service allows members to upload photographs of horse-racing programs and recap sheets and receive AI-generated analysis, including ranked picks, confidence scores, value flags, and pace projections. The Service is provided for educational and entertainment purposes only.
The Service does not place bets, accept wagers, hold funds, or process betting transactions of any kind. The Service is not a sportsbook, broker, financial advisor, or licensed betting operator.
3. No Betting Advice — No Guarantees
Get Fixed Bets does not tell members what to bet. All output is generated by our proprietary AI based on parameters our team has determined are statistically relevant. The AI ranks and scores horses; it does not guarantee any outcome. Past performance never predicts future results. Horse racing involves financial risk, including the loss of your wager. Members are solely responsible for all betting decisions and for verifying race information independently.
4. Eligibility
You must be of legal age in your country and jurisdiction of residence to use any betting service. The Service is available worldwide only where local laws permit AI analysis subscriptions and pari-mutuel wagering. You represent and warrant that you meet these requirements and that your use of the Service is lawful in your jurisdiction. We disclaim any liability arising from your use of the Service in a jurisdiction where it is unlawful.
5. Accounts and Subscriptions
You must create an account to use the Service. You are responsible for safeguarding your login credentials and for all activity under your account. You agree to provide accurate information and to keep it current.
Subscriptions are billed monthly in advance at the rate displayed at signup ($49.99 per month at the time of these Terms). Subscriptions renew automatically until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the then-current billing period. We may change pricing on a going-forward basis with reasonable notice.
6. 30-Day Money-Back Guarantee
If you are not satisfied with the Service within the first 30 days of your initial subscription, you may request a full refund of your first monthly payment by emailing support@getfixedbets.com. The 30-day guarantee applies only to your first subscription period and is not available for subsequent renewals.
7. License and Acceptable Use
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms. You agree not to:
- Resell, sublicense, redistribute, or commercially exploit any output of the Service;
- Scrape, copy, or systematically extract data from the Service;
- Reverse-engineer, decompile, or attempt to derive the source of any part of the Service;
- Use the Service in connection with any unlawful activity or in any jurisdiction where doing so is prohibited;
- Use automated tools (bots, crawlers, scripts) to access the Service except as we expressly permit;
- Interfere with or disrupt the Service or the servers or networks on which it operates.
8. User Content
When you upload photographs or other materials to the Service ("User Content"), you grant us a worldwide, non-exclusive, royalty-free license to process, store, analyze, and use the User Content for the purposes of providing and improving the Service, including training and improving our AI models. You retain ownership of your User Content. You represent and warrant that you have all rights necessary to upload the User Content and that doing so does not infringe any third-party rights.
9. Disclaimers
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, or accurate, or that the AI output will produce any particular result, financial or otherwise.
10. Limitation of Liability
To the maximum extent permitted by law, in no event will Get Fixed Bets, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, lost bets, data, use, or goodwill, arising out of or in connection with your access to or use of (or inability to access or use) the Service. Our aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the total subscription fees paid by you to us in the twelve (12) months preceding the event giving rise to the claim.
11. Indemnification
You agree to defend, indemnify, and hold harmless Get Fixed Bets and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, your violation of any applicable law or regulation, or your infringement of any third-party right.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including for violation of these Terms. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and indemnities) will survive.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after the effective date of any updated Terms constitutes your acceptance of the updated Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, except that you may have additional rights under the laws of your country of residence that cannot be waived.
